Our Privacy Policy

This is the Privacy Policy of the Bectran website https://www.bectran.com/ (the Site), operated by BECTRAN Inc. (together with our affiliates and subsidiaries, Bectran, we, us, our and terms of similar meaning) and our related products and services. It describes the information that we collect from you as part of the normal operation of our Site, and how we use and disclose this information. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. The use of information collected through our services shall be limited to the purpose of providing the services for which our Subscribers have engaged Bectran. By accepting the Privacy Policy in registration or by visiting and using the Site, you expressly consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy.

In this Privacy Policy, we use the following terms to describe different types of visitors to our Site. Our customers are called Subscribers and our Subscribers customers are called Customers. We use the word staff to describe persons to whom Subscribers give staff access on the Site. Together these people are collectively described in this Privacy Policy as Users of our Site.

When and What Kinds of information we collect about you?

Personal Data you provide to us:

Our primary purpose in collecting personal information from you is to provide you with a safe, smooth, efficient, and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. We only collect personal information about you that we consider necessary for achieving this purpose.

In general, you can browse the Site without telling us who you are or revealing any personal information about yourself. Once you become a User, we will require you to provide us various information. As you use the Site you can also from time to time enter personal information about third parties. For example, if you are a Subscriber, you can enter personal information about your Customers or your staff.

You always have the option to not provide information by choosing not to become a User or by not using the particular feature of the Site for which the information is being collected.

Cookies and Other User and Ad-Targeting Technologies.

Cookies: To provide you the best browsing experience, we use technologies such as Cookies to allow you to enter your password less frequently during a session, and use data collection devices (such as Google Analytics), including cookies, on certain pages of the Site to help analyze our web page flow, measure promotional effectiveness, and promote trust and safety, to offer certain features that are only available through the use of a cookie and to allow us to provide information that is targeted to your interests.

BECTRAN Inc. and its partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base.

Cookies and Web Beacons: We partner with a third-party ad network to manage our advertising on other sites. Our ad network partner uses cookies and Web beacons (“Web Site Navigational Information”) to collect non-personally identifiable information about your activities on this and other Web sites to provide you targeted advertising based upon your interests. Web Site Navigational Information includes standard information from your browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Company’s web sites. How do we Use the Information We Collect?

We use personal information in the file we maintain about you, and other information we obtain from your current and past activities on the Site for the following purposes:

How do we keep your data secure?

Bectran strives to protect our Users’ personal information. For security of transactions, we use the Secure Sockets Layer (SSL) protocol, which encrypts any information, such as credit card number and billing information, you send to us electronically. The encryption process protects your information, by scrambling it before it is sent to us from your computer. Once Bectran receives your transmission, we make commercially reasonable efforts to ensure its security on our system. Children’s Policy?

Bectran does not intentionally collect information from the individual under the age of sixteen (16) or minors as defined by the law or regulation. If you believe that we collect information from someone under the age of 16 or from a minor as may be otherwise defined in your country, please email us at privacy@bectran.com. We will then investigate further and if appropriate, we will take necessary measures to delete that information.

Our Disclosure of Personal Information?

We will not sell or rent your personally identifiable information to third parties without your explicit consent. The following describes some of the ways that your information may be disclosed in the normal scope of business to provide our services:

Bectran Inc. will only collect, use, and disclose information as described in this privacy policy. COMPANY will offer individuals the opportunity to choose (opt-out) whether their personal information is (a) to be disclosed to a non-agent third party, or (b) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. Bectran Inc. will provide individuals with reasonable mechanisms to exercise their choices.

Subscribers and Customers
In the normal operation of the Site Subscriber information are disclosed to the applicable Customers, and Customer information is disclosed to the applicable Subscriber. In general, information you enter on the Site is available to the other persons whether they are Customers, Subscribers, staff members or others to whom you give access to your account or to whom you give access to the information through the normal operation of the Site.

Billing
We use credit card and other payment information (such as PayPal email addresses) you submit to us on the Site to process payments you make through the Site. We do not store credit card or other payment method information unless the Subscriber or their Customers choose to enter credit card information for use in the Bectran recurring profiles module; in all other cases financial institutions (like PayPal) have the sole and complete responsibility for the storage of credit card and payment information.

Service Providers
We may from time to time use the services of affiliates, subsidiaries and unrelated service providers in the operation of the Site, and may disclose personal information to them in the course of our use of their services. For example, we may use the services of third-party hosting companies to host the operation of the Site. This may involve the hosting of data, including personal information, on servers operated by those hosting companies. We may also use 3rd parties to help us process customer support requests. These companies are authorized to use your personal information only as necessary to provide these services to us. We take care to use only service providers that we believe are reputable and able to live up to our and your expectations, including about the handling of confidential information.

In certain situations, BECTRAN Inc. may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Legal Requests; Emergencies
We cooperate with law enforcement inquiries and demands for information that are made under force of law. Therefore, we may provide personal information to law enforcement agencies in what we believe to be emergency situations, we may provide personal information where required by statute, court order, subpoena or similar legal process or lawful authority, and we may provide it to our legal counsel in connection with the foregoing. We may also disclose your information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others or investigate fraud.

Merger, Acquisition or Bankruptcy
If Bectran is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information,

Your Use of Other Persons' Information
In order to facilitate the services provided by the Site, the Site allows you in certain circumstances to give other Users limited access to the personal information of other persons. For example, if you are a Subscriber, you may use the Site to give access to a staff member to the personal information of your Customers. By entering into our Terms of Service, you agree that, with respect to the personal information of other persons that you collect, use and disclose on the Site, you have all necessary consents and rights to collect, use and disclose that information as described in this Privacy Policy from time to time, and you agree that the indemnity you give to us in the Terms of Service applies to any non-compliance by you with the foregoing.

3rd Party Data Collected Through the Bectran Services

Bectran collects and processes 3rd party personally identifiable information under the direction of our Subscribers. We have no ownership of this information or any direct relationship with individuals whose personally identifiable information may be processed as part of providing our Service. To the extent that you disclose your information to other parties through the Site, whether they are Subscribers or Customers or otherwise, different rules may apply to their use, collection and disclosure of the personal information you disclose to them. Since we do not control the information use, collection or disclosure policies of third parties, you are subject to their privacy policies. We encourage you to ask questions before you disclose your personal information to others.

We may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the service agreements with our Subscribers.

An individual who seeks access, who seeks to correct, amend, delete inaccurate data or withdraw consent to further contact should direct his/her query to the Bectran Subscriber they interact with directly (the data controller). If a Bectran Subscriber requests that we remove personally identifiable information on their behalf, we will respond to their request within 30 days.

Bectran will retain personal data we process on behalf of our Subscribers for as long as needed to provide services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

User Access and Choice

Upon request Bectran will provide you with information about whether we hold any of your personal information. If your personal information changes, you may correct, update, amend or remove it in some cases by making the change on your user account settings page or you can submit support ticket at support@bectran.com

If you wish to discontinue your service with us, you may email us at support@bectran.com or by contacting us by telephone or postal mail at the contact information listed below. We will respond to your request within 30 days.

If you would like us to delete/overwrite the personal information from our records, then please contact us by email to privacy@bectran.com or support@bectran.com or by contacting us by telephone.

Our Customer’s client must contact customer directly with any data subject access requests. If Bectran receive any request from it’s customer’s clients, Bectran will notify the customer relating to an individual’s rights to access, modify, correct, delete or block data subject’s personal information.

We will retain your personal information for as long as your account is active, as needed to provide you services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Opt-Out Preferences. We may use your name and email address to send out occasional promotional or other non-transactional emails. Out of respect for your privacy, you may choose to stop receiving these emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or you can contact us at privacy@bectran.com.

EU-U.S. Data Privacy Framework Participation

Bectran Inc. complies[comply] with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) as set forth by the U.S. Department of Commerce. Bectran Inc. has[have] certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern. Bectran Inc. is responsible for the processing of personal data it receives, under the EU-U.S. DPF, and subsequently transfers to a third party acting as an agent on its behalf. Bectran Inc. complies with EU-U.S. DPF Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.

The Federal Trade Commission [AND/OR U.S. Department of Transportation] has jurisdiction over Bectran Inc.’s compliance with the EU-U.S. DPF. In certain situations, Bectran Inc. may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

In compliance with the EU-U.S. DPF, Bectran Inc. commits [commit] to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF to TRUSTe, an alternative dispute resolution provider based in the United States.
